Walsh, Colucci, Lubeley, Emrich & Walsh's Eminent Domain Practice Group accepts eminent domain cases only from property owners and tenants, and defends their constitutional and statutory rights to just compensation. The firm's experience in complex zoning and development matters, coupled with its experience in eminent domain negotiation and litigation, allows Walsh Colucci to provide a comprehensive approach to resolving and, if necessary, litigating all categories of eminent domain and takings matters. The firm's land use attorneys, planners and members of the Eminent Domain Practice Group work together to analyze zoning and development issues that are complicated by the threat, or filing, of a condemnation action. Together with the client and its other consultants, members of the practice group work with the condemning authority (i.e., VDOT, power companies, local governments, etc.) to resolve zoning and development issues and obtain just compensation for the owner because of the property acquired and the damages to the remaining property. Many eminent domain cases are resolved prior to trial, but if this is not possible the members of the Eminent Domain Practice Group have the experience necessary to present the property owner's case to the court. McWilliams, who assists clients in making lost profit claims, if available, and who provides guidance to clients who seek to defer federal tax liability through a 1033 exchange.
